These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors consulting services typically in relation to the private childcare field. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

 

Website Users

 

In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

 

Services Offered​

 

Nanny Consults offers a variety of services to nannies, newborn care specialists, postpartum doulas, parents, placement agencies and other caregivers. These services may include: crafting documents for private caregivers and their businesses, parents or placement agencies; selling pre-generated documents via the website; coaching parents or caregivers of young children in a variety of areas such as sleep or nutrition; in-person services such as sleep consulting or newborn care services; training or speaking on related childcare topics; coaching caregivers in interview skills; providing mediation or advice regarding conflict resolution within private caregiving relationships; and any other service we may choose to offer in the future including those made by personal request.

We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

Some services may include purchase of pre-generated or personalized documents of a legal nature. These documents, and any related instructions, are not intended to provide legal, business or tax advice, and are furnished without representation or warranty. Nanny Consults is not and does not claim to provide legal or tax services and Wendy Sjaardema is not an attorney or a tax professional. While these documents are believed to satisfy minimum legal requirements as of the dates each are created and/or revised, compliance with applicable law remains the responsibility of the user of such documents. We recommend all documents be reviewed by the user's legal, business and/or tax advisor(s).

Purchasing a PDF Download

 

When purchasing an item, such as a PDF download, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it; and (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

The prices we charge for our PDF downloads and other items available for direct purchase are listed on the website. We reserve the right to change our prices for items displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the payments page.

The fee for the item and any other charges you may incur in connection with your purchase, such as taxes and possible transaction fees, will be charged to your payment method. Once payment is completed, you will receive your download by email.

Purchasing a Personalized Service 

 

When purchasing a personalized service, such as a resume or personalized contract, you agree that: (i) you are responsible for reading the full service details provided by private email before making a commitment to buy it; and (ii) you enter into a legally binding contract to purchase the service when you you complete the check-out payment process.

The prices we charge for our personalized services are detailed in the informational e-mail you will receive after requesting more information. We reserve the right to change our prices for personalized services at any time, and to correct pricing errors that may inadvertently occur. 

The fee for personalized services and any other charges you may incur in connection with your purchase, such as taxes and possible transaction fees, will be billed to you directly via Quickbooks and can be completed by secure ACH transfer via the Quickbooks invoice link. Payments completed by check may delay the start of service until the check clears, which may affect the completion deadline. If a check does not clear, you will be responsible for payment for any cancelled check fees in addition to the cost of your personalized service. 

 

We currently do not accept payments via credit card for personalized services. If you have no option other than a credit card, please contact me directly at nannyconsults@gmail.com to discuss alternatives.

Purchasing an In-Person or Virtual Service​

​

When purchasing an in-person or virtual service, such as sleep consulting or general consulting, you agree that: (i) you are responsible for reading the full service details provided by private email before making a commitment to buy it; (ii) you enter into a legally binding contract to purchase the service when you you complete the check-out payment process; and (iii) you have committed to the scheduled time for the in-person or virtual meeting prior to the purchase of the service.

 

The prices we charge for our in-person and virtual services are personalized based on your individual needs and will be detailed in the e-mail exchanges prior to the payment process. We reserve the right to change our prices for these services at any time, and to correct pricing errors that may inadvertently occur. 

 

The fee for in-person/virtual services and any other charges you may incur in connection with your purchase, such as taxes and possible transaction fees, will be billed to you directly via Quickbooks and can be completed by secure ACH transfer via the Quickbooks invoice link or by personal/business check. Payment by check must clear prior to securing the scheduled time for your in-person/virtual service. If a check does not clear, you will be responsible for payment for any cancelled check fees in addition to the cost of your personalized service.

In-Person/Virtual services should be scheduled prior to completion of payment. If you are not able to attend a scheduled meeting, please give a minimum of 72 hours notice to reschedule. Additional charges will apply if you are unable to provide such notice.

Return and Refund Policy

​

Nanny Consults prides itself on excellence in all services offered and has developed a highly regarded reputation within the private childcare industry. We make every effort to ensure each and every client is satisfied prior to completing our service. Our services are created in such a way that there are multiple opportunities to request changes and/or submit concerns to ensure you are happy with your purchase. Each service relies on time spent researching, creating and personalizing utilizing knowledge gained from years of industry experience. As such, the price set for each service and/or download reflects not only the product, but the time and experience needed to create it.

Unless otherwise agreed upon in a signed and dated legal document between a client and Nanny Consults, all sales are final. This includes PDF Downloads, personalized services, in-person services, virtual services and any other service Nanny Consults offers now or in the future. If you have a question or concern regarding any service or item offered for sale, please contact nannyconsults@gmail.com prior to completing payment.

 

Once payment has been completed, no refunds, credits or substitutions will be offered and no returns will be accepted. This includes unused services as noted below, unless otherwise agreed upon in writing by Nanny Consults:

• Personalized service purchases expire after 6 months if they have not been used. 

• If you are purchasing an in-person/virtual service for future use, the service must be scheduled within 60 days of purchase.

• If you reschedule an in-person/virtual service, you must reschedule within 30 days of original scheduled appointment or forfeit the service.

• If you a purchasing a service as a gift, the gift certificate expires after 6 months if it has not been used.

Use of Purchases​

Nanny Consults services, downloads, personalized documents created for clients and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Wendy Sjaardema. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof. Failure to abide by this policy may result in legal action.

Right to Suspend or Cancel

 

We may permanently or temporarily terminate or suspend your access to any service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may request to cancel your services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment

Indemnification

You agree to indemnify and hold Nanny Consults, Wendy Sjaardema LLC and Wendy Sjaardema harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

 

Limitation of Liability

 

To the maximum extent permitted by applicable law, in no event shall Nanny Consults be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

To the maximum extent permitted by applicable law, Nanny Consults assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our services; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

 

Right to Change and Modify Term

 

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our services after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or any services offered.

 

Promotional Emails and Content

 

You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices, you can notify us at any time. 

 

Preference of Law and Dispute Resolution

 

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of the State of Colorado, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in the city and county of Denver. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.
